Ways of working
Every phase outlined here is a communication touchpoint. Direct client approval is needed for me to progress and falls under the “communication” clause in my TOS below.
Quote
This is the start of our exciting journey together as artist and client! When you submit a commission quote request form on my website, I will review your idea and send an appropriate price for your consideration. My prices are based off of my personal hourly rate, along with the fact that I am a professional and deliver (or fully refund) 100% of the commissions that I accept. And yes, I am happy to illustrate adult/NSFW art, we can talk to decide on if my art style is right for your idea.

So we’re both happy with the idea, payment has been received, and it’s time for pen to hit (virtual) paper! I will outline a very loose concept for you to consider, to make sure that I’ve got the initial direction right. You may request one free alteration at this point. Further alterations may be requested, but will be an additional $25 each. An alteration at this phase means that I totally scrap the composition and draft a new one.
Rough sketch
The thumbnail is feeling right and we’re excited to see your concept move forward - it’s time to sketch! This is a phase of exploration where I make sure that I’m getting loose details down. Anatomy and perspective may still be a little weird here and that’s normal, the goal is to flesh out the idea more. You may request one free alteration at this point. Further alterations may be requested, but will be an additional $25 each. An alteration at this phase means that I significantly adjust an area of the concept.
Refined Sketch
Things are moving along swimmingly and it’s about time we fix up any of those pesky anatomy and perspective errors. Full detailing will be added and you may think to yourself, “Wow this looks great, do we even need inks?” (the answer is yes - if I’m adding color!). You may request one free alteration at this point. Further alterations may be requested, but will be an additional $25 each. An alteration at this phase means that I adjust an extremely specific part of the sketch. If you’ve paid for a sketch commission, this is the end of the line. I hope you love it!
Inks and colors
Buckle-up! This is it, with the refined sketch approved I’m going to have the full green light to take your concept and push it through to completion. This phase is highly detailed and can take the longest, so please be patient! I assure you, I will set timeline expectations with you before I get started and I will send the finished result in a timely manner. Upon final delivery I really hope you can give me your honest feedback on the work and your experience. Thank you so much for supporting a small indie artist!

Expectations
The purpose of the terms and conditions outlined within this Terms of Service is to ensure a smooth transaction between the artist and the customer. By paying for a commission from the artist in question who is referencing these Terms of Service you [the customer] have wholeheartedly agreed to uphold them and have expressly stated that you understand the terms outlined within this document. By accepting your [the customer's] payment, I [the artist] wholeheartedly agree to uphold the terms outlined within this document and acknowledge that I have full understanding of these terms and conditions. These terms can and may change at any point and will be reflected immediately upon any orders that are not currently in progress.
From this point forward "I", "me", and "myself" will be used to dictate the terms of the artist and "you", "your", and "yourself" will be used to dictate the terms of the customer.
Refusal of Service
I reserve the right to refuse any order or transaction for any reason.
Age Requirements
You must be 18 or older to order a project from me.
Will Not Draw
I will not draw any of the subjects detailed in this list unless I otherwise explicitly say so. Failure to respect this list and pressure for anything on it to be drawn will be considered harassment and will be dealt with as such. I will not illustrate:
- Depictions of underage characters in adult or otherwise mature scenarios.
- Fecal matter, urine, or non-stylized vomit.
- Rape.
- Sexualization of gore.
Requirements For Work
I will not begin working until a reference sheet has been provided (or a robust and appropriate description that I have accepted during the quote phase). I will not seek out (i.e. look through galleries) or assume which reference should be used; the customer must explicitly provide the reference themselves. Not safe for work and safe for work references are allowed. References must be two dimensional drawings with flat colors (no shading) or flat color swatches must be available on the reference sheet itself. A reference of the commissioned body part (i.e. Head, full body, etc.) must be provided for work to begin or be accepted.
Payment
Payment will be accepted in full at the beginning of the project. I do not offer payment plans. Payment will be accepted through PayPal or Square Cash unless the transaction is agreed upon in person in which this is the only case where cash will be accepted. No other forms of payment are accepted.
Refunds
The customer may request a full refund at any point before work has begun. Once progress has begun, there are absolutely no refunds unless I decide to cancel your order, in which case I will always provide a full refund.
Communication
I will maintain communication through email. I do not use other methods of communication for deliverables. I will provide heavily watermarked works-in-progress at pre-set increments (see: Ways of Working outlined above) until the completion of the project. You will maintain communication with the artist throughout the process of the order. If either party fails to maintain communication then the project may be canceled and subject to any relevant clauses outlined below. Failure to communicate means a sudden drop in communication from either party for 30 days despite 2 attempts to reach out by either party. Timeline expectations will be established at the beginning of the project.
Cancellation - Artist
If at any point I cancel the order with the customer then I maintain the right to re-use any non identifying parts of the illustration (for example, an already agreed upon pose or background). At no point am I required to elaborate the reasoning behind my cancellation. Failure in communication from you results in me being able to cancel the order. I will provide a full refund to your original method of payment.
Cancellation - Customer
You may cancel the project and request a full refund at any point before work has begun. Once progress has begun, there are absolutely no refunds. However, you may choose to cancel the project at any point.
Copyright
I reserve and hold the rights to all works of art that I create under this contract. These works may be used for purposes such as, but not limited to, advertisement for commercial gain, merchandise, books (i.e. art books and art collections), etc. I do NOT gain rights to your character or intellectual properties. Revocation of these rights may be agreed to for an additional fee.
You gain limited rights to your piece that are outlined as follows:
You Cannot
Use the artwork for advertising or self-promotion. If you wish to commission a piece to use to direct traffic to your own cause, promotion, sales page, etc. then an appropriate fee needs to be assessed for these rights. Examples include, but are not limited to: promotional images, sales listings, shop/promotional banners/backgrounds, overlays, and so on.
Use the artwork for merchandise. This is to prevent people from trying to profit from my artwork without my consent. You also can't create products or derivatives of my artwork for the same reason. This includes, but is not limited to: prints, posters, art books, digital sales, etc.
Sell the artwork and the rights to it, or give the artwork away to another entity for continuous use. Unless you have paid for full rights to the image this violates several of my rights. Giving the image to another entity for use as continuous promotion, printing, marketing, etc. is forbidden.
Edit the image. With the exception of cropping and resizing outlined in the “You Can” section below you cannot transform, alter, color, shade, color change, trace, or otherwise edit the artwork. I ask that you leave my artwork as it is upon completion.
You Can
Make personal items from this artwork. Items such as prints, dakimakuras, backpacks, pillows, etc may be created one time for the sole, individual use of the owner of this artwork.
Crop or resize the artwork for personal use. Anything that is non-promotional in nature may feature this artwork. This includes icons, banners on social media, etc.
Purchase my working file and the ability to have the piece colored, “finished”, or animated. You cannot have this artwork “completed” or otherwise edited unless you purchase access to these files.
Buy the full rights to this image at any time. I ask that you understand that in buying the full rights to the image I still retain my original rights as well. You may purchase the full rights to this image AND pay additionally for the revocation of my rights over the image at any time.
